Look, but don't touch. Wish I had a nickel for every time I was told that as a kid growing up in Missouri. There's a new law that's now in effect where even looking is illegal and you definitely better not touch - or else.

The new Missouri law that I'm referring to isn't completely "new". It was put into effect on January 1, 2025, but we're now approaching the time when full enforcement will begin.

What is the "No Touch" law in Missouri?

Save MO Lives specifies this is the new legislation that forbids you to touch your smartphone or any electronic communications device when you're driving. The perception is that this "no touch" law in Missouri would only be warnings and no fines. Now, that's not completely accurate.

What is the punishment for being caught touching...your phone while driving?

Here's what can happen if law enforcement sees you on a device while driving:

  • 1st conviction in two years: up to a $150 fine
  • 2nd conviction in two years: up to a $250 fine
  • 3rd or more conviction in two years: up to a $500 fine

There are some exceptions to this no touch Missouri law though...

  • You can touch your phone while driving if reporting an emergency to law enforcement or any emergency entity
  • You can also touch your phone if you're lawfully pulled over and/or stopped
  • Emergency personnel can use phones while driving in emergencies

As of this writing, law enforcement in Missouri is NOT allowed to pull you over just for violating the "no touch" law according to Save MO Lives. I have to wonder though how much more likely it might be for you to be pulled over for something else IF they also notice you're on your phone. I wouldn't want to chance it, but that's just me.
